In a significant legislative development, the federal government presented eight new amendments as part of the 27th Constitutional Amendment Bill in the National Assembly, including a notable change to Article 176 of the Constitution. Under the proposed revision, the current Chief Justice of Pakistan will continue to be recognized as Chief Justice of Pakistan until the completion of his constitutional term.
During Wednesday’s session of the National Assembly, Federal Minister for Law and Justice, Azam Nazeer Tarar, formally moved the motion for consideration of the 27th Amendment, stating that the proposed changes were earlier outlined in the Senate. He described the constitutional amendment process as an “evolutionary and reformative measure” intended to ensure institutional continuity and judicial stability.
The government’s presentation of the amendment aims to clarify the constitutional position of the Chief Justice following recent debates regarding judicial seniority and succession procedures. According to the revised provision of Article 176, Justice Yahya Afridi will continue to serve as Chief Justice of Pakistan until the natural expiry of his term. The amendment explicitly maintains that the title and powers of the Chief Justice of Pakistan will remain unchanged during this period.
Minister Tarar emphasized that the office of the Chief Justice would remain intact under the new arrangement, ensuring there is no ambiguity about judicial hierarchy or authority within the Supreme Court. Furthermore, the amendment stipulates that among the judges of the constitutional and supreme courts, the most senior judge will continue to hold the title and responsibilities of Chief Justice of Pakistan.
Legal analysts view this move as an attempt to reinforce the independence and administrative stability of the judiciary amid ongoing political and institutional discussions about constitutional reforms. They note that the introduction of eight additional amendments under the 27th Constitutional Amendment Bill suggests the government’s intention to introduce broader structural adjustments within the judiciary and constitutional framework.
