The Peshawar High Court has ordered the release of 23 more Pakistan Tehreek-e-Insaf (PTI) workers arrested under Section 3 of the 3-MPO, granting them interim relief.
A two-member bench comprising Justice Sahibzada Asadullah and Justice Inamullah heard petitions filed by 23 workers, including Akbar Sher, Shehzad, Razaullah, Saqib, Ehsanullah and Momin Khan, challenging their arrests.
The petitioners’ lawyers, Yasir Khattak and Azhar Rahim Khan, appeared before the court along with Khyber Pakhtunkhwa Advocate General Sanaullah and relevant officials.
According to the court order, the Deputy Commissioner of Mardan had been directed at the previous hearing to explain why and under what circumstances the workers had been detained.
However, the required report has not yet been submitted.
The court observed that, in the absence of the report, it had no option but to consider the available record and provide relief to the petitioners.
Noting that relief had also been granted in similar cases earlier, the bench ordered the release of all 23 petitioners against surety bonds of Rs 100,000 each, supported by two sureties.
The court clarified that the case would continue to be heard on merit.
It directed the Deputy Commissioner to submit the required report and relevant record and adjourned further proceedings until November 12.
