The federal government on Friday filed a fresh review petition in the Supreme Court (SC) against its order directing the transfer of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan to a hospital in Islamabad.
The miscellaneous review petition was filed by the Chief Commissioner of Islamabad after the objections raised by the Supreme Court registrar’s office were removed.
The new petition argues that there are legal shortcomings in the court’s order regarding Imran Khan’s transfer to hospital. It states that the jail rules were overlooked and that the government was not made a party to the main case.
The government has asked the Supreme Court to accept the review petition and reconsider its August 18 order.
The development comes a day after the federal government withdrew its earlier review petition against the Supreme Court’s order.
The earlier petition had been filed after the Supreme Court directed authorities to shift Imran Khan from Adiala Jail in Rawalpindi to Shifa International Hospital in Islamabad for medical examination and treatment.
The government had argued that the order overlooked jail rules and contained legal shortcomings. It had also said that the order was issued without serving notices on the relevant parties or giving them an opportunity to present their position.
The government had further argued that important legal questions concerning the maintainability of the case were not properly considered and that final relief could not be granted at an interim stage.
On August 18, the Supreme Court ordered that Imran Khan be shifted to Shifa International Hospital within two days for medical examination and treatment. The court also directed that he be allowed access to his personal physician and greater contact with his family.
