The Lahore High Court (LHC) upheld an order directing the registration of a criminal case against Punjab Enforcement and Regulatory Authority (Pera) official Tauqeer Asif, ruling that the authority’s officials are not immune from criminal law.
Justice Muhammad Ajmal Zahid issued the eight-page judgment while dismissing a petition filed by Tauqeer Asif challenging the Justice of Peace’s order to register a case against him.
The court ruled that being a Pera official does not grant immunity from criminal proceedings and that general criminal laws apply to allegations involving independent criminal offences.
The judgment stated that allegations of torture, stripping, filming and robbery fall within the scope of general criminal law and must be dealt with in accordance with the applicable legal provisions.
The court upheld the Justice of Peace’s order and directed the station house officer (SHO) concerned to record the statement of the aggrieved citizen.
It ruled that if the complainant’s statement disclosed a cognizable offence, police must take action in accordance with the law.
The High Court further observed that proceedings initiated under the Pera Act do not prevent police from taking action over allegations of separate criminal offences.
The judgment clarified that statutory powers granted to Pera personnel do not exempt them from accountability under general criminal laws.
By dismissing Tauqeer Asif’s petition, the court maintained the order for police action in accordance with the law, establishing a judicial precedent concerning the criminal liability of Pera officials.
