Judiciary Decides to Introduce New Mechanism Against Enforced Disappearances, Mandatory Production of Accused Before Magistrate Within 24 Hours

The National Judicial Policy Making Committee (NJPMC) has decided to introduce a new institutional mechanism to address cases of enforced disappearances, making it mandatory for arrested individuals to be presented before a magistrate within 24 hours. The decision was taken during an important meeting of the committee held under the chairmanship of Chief Justice of Pakistan, Justice Yahya Afridi.

According to an official statement issued after the meeting, the committee reached a consensus on adopting a more effective and coordinated judicial response to cases of enforced disappearances, which have remained a serious human rights concern in the country. The participants agreed that failure to produce an arrested person before a magistrate within the constitutionally mandated timeframe undermines the rule of law and erodes public trust in state institutions.

The meeting was attended by senior judges of the Supreme Court, chief justices of high courts, and other key judicial stakeholders. During the deliberations, the committee emphasized that strict adherence to constitutional guarantees, particularly Article 10 of the Constitution of Pakistan, is essential to ensure protection of fundamental rights and prevent abuse of power by law enforcement or other authorities.

Under the proposed new mechanism, any authority involved in the arrest or detention of an individual will be legally bound to ensure the accused is presented before a magistrate within 24 hours. Failure to do so will trigger immediate judicial scrutiny and accountability proceedings. The committee noted that this step is aimed at closing existing gaps in the legal process that have allowed unlawful detentions to persist without timely oversight.

Chief Justice Yahya Afridi, while addressing the meeting, stressed that enforced disappearances not only violate constitutional and legal norms but also cause deep anguish to families and damage the credibility of the justice system. He underscored the judiciary’s responsibility to act decisively and proactively to protect citizens’ rights and ensure that no one is deprived of liberty without due process.

In addition to the issue of enforced disappearances, the committee also discussed broader judicial reforms to improve efficiency and reduce delays in the justice system. One of the key decisions taken during the meeting was the implementation of a “Commercial Litigation Corridor” to ensure swift disposal of commercial and business-related cases. The initiative aims to provide certainty and confidence to investors and the business community by ensuring timely resolution of disputes.

The committee agreed that designated courts and streamlined procedures would be introduced under this corridor, with clearly defined timelines for different stages of litigation. It was emphasized that judges and court staff would be required to strictly adhere to these timelines to avoid unnecessary delays that have historically plagued commercial litigation in Pakistan.

The official communiqué further stated that the NJPMC decided to enforce strict compliance with prescribed timelines for delivering judgments across all categories of cases. Delayed judgments not only affect litigants but also contribute to case backlogs, undermining the overall effectiveness of the judicial system. The committee resolved that performance monitoring mechanisms would be strengthened to ensure accountability within the judiciary itself.

Participants of the meeting highlighted that judicial reforms must go hand in hand with institutional coordination among courts, prosecution departments, and law enforcement agencies. Effective implementation of the new mechanism against enforced disappearances will require close cooperation between the judiciary and executive authorities, as well as proper training and awareness among magistrates and police officials.

Legal experts believe that the decision to make the 24-hour production rule more enforceable could mark a significant step toward curbing illegal detentions. They argue that consistent judicial oversight at the earliest stage of detention can deter misuse of authority and ensure that arrests are carried out strictly in accordance with the law.

Human rights advocates have long demanded stronger safeguards against enforced disappearances, calling for transparent procedures and independent oversight. While welcoming the judiciary’s decision, they stress that effective implementation will be key to translating policy decisions into real relief for affected families.

The National Judicial Policy Making Committee reiterated its commitment to strengthening the rule of law, safeguarding fundamental rights, and enhancing public confidence in the justice system. The committee emphasized that judicial reforms are an ongoing process and that continuous evaluation and improvement are necessary to meet evolving legal and societal challenges.
