MUZAFFARABAD: The Government of Azad Jammu and Kashmir (AJK) has formally launched legal proceedings against Shaukat Nawaz Mir and Khawaja Mehran Arshad on allegations of sedition and activities deemed hostile to the state. The move comes amid growing political tensions and follows the emergence of an alleged audio recording that authorities believe may be linked to recent unrest in the region.
According to an official statement issued by the AJK Home Department, investigations have been ordered into speeches, writings, publications, and electronic communications attributed to the two individuals. Authorities stated that the inquiry is being conducted under relevant provisions of the law to determine whether any offenses against the state have been committed.
Investigation Ordered Under Sedition Law
The Home Department confirmed that an investigation has been initiated against Shaukat Nawaz Mir under Section 124-A of the Azad Jammu and Kashmir Penal Code, a provision commonly associated with sedition-related offenses. Officials said that a preliminary review of the available material suggested that the allegations warranted a comprehensive legal examination.
According to the department, the evidence currently available indicates the need for further investigation in accordance with established legal procedures. Authorities emphasized that the inquiry will seek to determine the authenticity of the material under review and whether it constitutes a violation of state laws.
Directions Issued to Police Authorities
Under Section 196 of the Criminal Procedure Code, the government has instructed the relevant district police authorities to carry out detailed investigations and complete all necessary legal formalities.
The Senior Superintendent of Police (SSP) in Muzaffarabad has been directed to oversee and complete the investigation concerning Shaukat Nawaz Mir. Similarly, the SSP in Mirpur has been tasked with conducting and finalizing the inquiry against Khawaja Mehran Arshad.
Officials have been instructed to conclude their investigations and submit formal challans before the appropriate courts if sufficient evidence is found to support the allegations. The Home Department stated that the investigations would be conducted in accordance with the law and due process.
Link to Recent Unrest Under Examination
Government sources indicated that the inquiry gained additional significance after authorities noted what they described as similarities between an alleged leaked audio conversation and the violent incidents that took place in Rawalakot on June 6.
Law enforcement agencies are reportedly examining whether there is any connection between the statements made in the audio recording and the subsequent protests and disturbances witnessed in parts of Azad Kashmir. Investigators are expected to analyze communications records, public statements, and other available evidence as part of the process.
Officials have not yet released detailed findings regarding the alleged connection, stressing that the matter remains under investigation and that final conclusions will be drawn only after a complete review of the evidence.
Leaked Audio Recording Sparks Controversy
The latest development follows the circulation of an alleged audio recording that surfaced a day earlier and quickly attracted public attention. The recording is said to feature central leaders of the now-banned Joint Action Committee discussing plans and strategies related to protests in Azad Kashmir.
According to government officials, the conversation allegedly includes Shaukat Nawaz Mir and Khawaja Mehran Arshad speaking about protest activities and organizational matters. The authenticity of the recording has become a key aspect of the ongoing investigation.
Authorities are expected to conduct forensic analysis of the audio material to determine whether it is genuine and whether its contents have any legal implications. No official forensic report has yet been released.
Political and Legal Implications
The decision to invoke sedition-related provisions has added a new dimension to the political environment in Azad Kashmir. Legal experts note that cases involving allegations of anti-state activities are typically subject to extensive judicial scrutiny due to their constitutional and political significance.
Supporters of the government argue that any activity threatening public order or state institutions must be investigated thoroughly. Meanwhile, critics contend that all allegations should be evaluated carefully and transparently to ensure that legal action does not infringe upon legitimate political expression.
The case is expected to attract considerable attention from political parties, civil society organizations, and legal observers as the investigation progresses.
Due Process to Be Followed
Government officials have reiterated that the proceedings are currently at the investigation stage and that no final determination regarding guilt or liability has been made. They emphasized that the accused individuals are entitled to all legal protections available under the law and that any further action will depend on the outcome of the inquiries.
As investigators continue examining the allegations, the courts will ultimately determine whether sufficient evidence exists to proceed with prosecution. The outcome of the case could have important implications for the political landscape and governance of Azad Kashmir in the coming months.
For now, authorities maintain that the investigations are being conducted to establish the facts surrounding the allegations and to ensure that any violations of the law are addressed through the judicial process.
