Pakistan Tehreek-e-Insaf (PTI) Barrister Gohar has challenged the imposition of an emergency and governor’s rule in Khyber Pakhtunkhwa (KP) in the Peshawar High Court.
The petition was filed through Advocate Ali Zaman, contesting the measures introduced following the imposition of an emergency in the province.
On October 21, an emergency was declared in KP after the president signed the summary. The federal government subsequently issued a gazette notification under Article 232 of the Constitution, transferring provincial government powers to the governor.
An official statement said the decision was taken in response to rising terrorist attacks and a serious deterioration in law and order in the province. It said attacks targeting government installations, key infrastructure and law enforcement agencies had increased.
The statement also alleged that the provincial government had failed to demonstrate the necessary resolve or take effective measures to tackle terrorism and lawlessness.
Under the notification, the governor may perform provincial government functions assigned by the federal government. The federal government may also direct the governor to assume control of all or some provincial affairs.
The notification further states that the powers of the Khyber Pakhtunkhwa Assembly will be exercised by Parliament or under its authority.
