SUKKUR: Shopkeepers affected by the demolition of commercial units at Mehran Complex have filed a constitutional review petition before the Sindh High Court (SHC), Sukkur Bench, challenging the demolition of 42 shops, which they allege was carried out unlawfully despite the existence of official revenue records.
The petition has been filed by Muhammad Sharif Bandhani and other affected shopkeepers through their counsel, Advocate Zaheer Babar.
According to Advocate Zaheer Babar, the Sukkur Municipal Corporation (SMC), the Deputy Commissioner Sukkur, and other concerned administrative authorities demolished the shops despite documented revenue records supporting the petitioners’ claims, resulting in substantial financial losses for the affected business owners.
The petition argues that the Federal Constitutional Court has since set aside the Supreme Court’s earlier judgment in the Nasla Tower case. The petitioners contend that this subsequent ruling provides legal grounds for seeking a review of the proceedings that led to the demolition of the Mehran Complex shops.
The constitutional review petition names the Sukkur Municipal Corporation, the Mayor of Sukkur, the Deputy Commissioner Sukkur, and other relevant officials as respondents.
The petition requests the Sindh High Court to re-examine the earlier action concerning the demolition, assess whether the authorities acted in accordance with the law, and grant appropriate legal relief to the affected shopkeepers.
It also asks the court to summon all relevant official records, review the legality of the demolition proceedings, and decide the matter in accordance with the Constitution and applicable laws.
The allegations contained in the petition represent the position of the petitioners. The court has yet to hear the matter, and no response from the respondent authorities was available at the time of filing this report.
