Upholding the Lahore High Court’s (LHC) verdict in the favour of Hamdard Laboratories, the Federal Constitutional Court (FCC) on Thursday rejected the Lahore Electric Supply Company’s (LESCO) appeal.
A two-member bench, headed by Justice Aamer Farooq, heard the case.
During the hearing, Justice Farooq asked that if the meter had a defect in it, then who was responsible for that. “Meter is LESCO’s property,” he said, adding there was no charge against the consumer that it had tampered with the meter.
Speaking on the occasion, LESCO’s lawyer said that the consumer’s front and back both meters were defective. “That’s why there was average billing,” he added.
Counsel for Hamdard told the court that as per fact-finding, there were no issues with the backup meter.
