The District and Sessions Court of Islamabad on Monday issued a show-cause notice to the Chairman of the Capital Development Authority (CDA) and directed him to appear in person at the next hearing in a case concerning the implementation of a court decree issued in 2000.

The case, titled “Muhammad Rashid versus Chairman CDA”, was heard by Civil Judge Nasiruddin. The court had previously issued arrest warrants for the CDA chairman in connection with the matter.

The petitioner had obtained a decree in his favour in 2000. The case later reached the Supreme Court, which upheld the decision in favour of the petitioner.

Muhammad Rashid maintains that he is among those affected by the CDA’s land acquisition. According to his position, the authority acquired his land but has not provided him the benefits available under its rehabilitation and resettlement policy.

The petitioner told the court that the decree had not been fully implemented despite the earlier judicial decisions.

Barrister Hasnain Haider Thaheem appeared before the court as counsel for the petitioner. He requested the court to ensure the effective and complete implementation of the decree.

After hearing the matter, the court issued a show-cause notice to the CDA chairman and ordered him to appear in person at the next hearing.

The court also directed the relevant officials to ensure implementation of the decree and ordered that they face legal proceedings in connection with compliance.

The proceedings concern the enforcement of the decree granted to Muhammad Rashid in 2000 and upheld by the Supreme Court. The petitioner is seeking the benefits he says are due under the CDA’s rehabilitation and resettlement policy following the acquisition of his land.
