Giving an important decision regarding the seniority of employees, the Supreme Court (SC) on Tuesday said it was mandatory to hear the employees before changing their seniority.
A nine-page verdict was authored by Justice Muhammad Ali Mazhar.
The apex court further declared that even if seniority had been granted to an employee in violation of rules and regulations, it could not be changed without listening to him or her. “Seniority is an employee’s precious right since prospects of progressing in career are linked to it,” the court added.
The SC noted that the former bench overlooked an important point of giving the employee an opportunity to present his point of view.
The court went on to say that changing the seniority of Sindh Police personnel without listening to them was a violation of article 10-A of the constitution.
Partially accepting the police personnel’s review petitions, the SC took back the decision dated April 4, 2024.
The apex court ordered the police department to listen to the affected employees before deciding on their seniority, and release a new list in case objections to their seniority were found correct or they had been granted seniority in violation of rules.
