The Sindh High Court has disposed of petitions concerning the M-9 Motorway right-of-way, land ownership and toll collection dispute, referring the matter to the competent authorities of the Sindh government for a decision.
The court directed the National Highway Authority (NHA) to submit a formal reference to the provincial government.
The competent authority was ordered to hear all parties and decide the matter within 45 days.
The court said the existing status quo regarding the M-9 Motorway would remain in force until the competent authority reaches a decision.
The NHA, affected individuals and other parties have been allowed to present their respective positions before the authority.
The court directed that the competent authority issue a comprehensive order in accordance with the law and ensure transparency in the proceedings.
During the hearing, counsel told the court that the Sindh government had leased land for the motorway to the NHA in 2012.
The NHA’s counsel argued that the lease was cancelled in 2017 and contended that the cancellation was contrary to law.
The Sindh government’s counsel, however, maintained that the land remained the property of the province and said the transfer of land to the authority had already been cancelled.
The provincial government’s counsel also alleged that the NHA was disposing of land under the guise of providing access and argued that the authority could not collect tolls without paying for the land.
The NHA’s counsel, meanwhile, claimed that the Sindh government intended to take control of the motorway and collect toll revenue itself.
