ISLAMABAD:<\/strong> Pakistan\u2019s National Accountability Bureau (NAB) is considering a new legal interpretation aimed at preventing a large number of corruption cases from being closed or withdrawn following an increase in the bureau\u2019s financial jurisdiction threshold, according to a report citing informed sources.<\/p>\n\n\n\n

The proposal, which has reportedly been discussed within NAB, is expected to be presented before the bureau\u2019s Executive Board Meeting (EBM)<\/strong> for policy consideration.<\/p>\n\n\n\n

Proposed Interpretation<\/h3>\n\n\n\n

According to the report, the proposal seeks to apply the same inflation-adjustment principle used to increase NAB\u2019s financial threshold to the alleged financial loss caused by corruption.<\/p>\n\n\n\n

Under amendments to the NAB law, the minimum financial threshold for the bureau\u2019s jurisdiction\u2014previously Rs500 million<\/strong>\u2014has reportedly increased to approximately Rs800 million<\/strong>, reflecting inflation-based adjustments linked to official price indices.<\/p>\n\n\n\n

The proposed interpretation suggests that if inflation is taken into account to raise the jurisdictional threshold, it should also be used to reassess the current value of the alleged financial loss<\/strong> suffered by the affected party, whether that party is an individual, a government institution, or the national exchequer.<\/p>\n\n\n\n

Impact on Pending Cases<\/h3>\n\n\n\n

According to the proposal, if an accused argues that an alleged corruption amount now falls below the revised financial threshold and is therefore outside NAB\u2019s jurisdiction, the value of the allegedly embezzled or misappropriated funds would also be recalculated based on inflation.<\/p>\n\n\n\n

Such a reassessment could significantly increase the present-day value of the alleged loss, potentially bringing the case back within NAB\u2019s jurisdiction despite the higher financial threshold.<\/p>\n\n\n\n

Sources quoted in the report said the proposal is based on the principle that the effects of inflation should not benefit only the accused. They argue that inflation should also be considered when assessing the real value of losses allegedly suffered by victims or the public treasury.<\/p>\n\n\n\n

Executive Board Yet to Decide<\/h3>\n\n\n\n

The proposal has not yet been approved, and no final decision has been made.<\/p>\n\n\n\n

According to the report, if the Executive Board Meeting endorses the interpretation and NAB formally adopts it, the number of corruption inquiries, investigations, and references that might otherwise be closed because of the revised jurisdictional limit could be significantly reduced.<\/p>\n\n\n\n

Earlier amendments to the NAB Ordinance linked the bureau\u2019s minimum financial threshold of Rs500 million<\/strong> to inflation indices published by the Pakistan Bureau of Statistics<\/strong>, with effect from July 1, 2022<\/strong>.<\/p>\n\n\n\n

According to NAB sources cited in the report, cumulative inflation since that date has increased the effective jurisdictional threshold to around Rs800 million<\/strong>.<\/p>\n\n\n\n

Following the amendment, concerns reportedly emerged within accountability circles that numerous ongoing inquiries, investigations, and court references involving amounts below the revised threshold could be withdrawn or closed due to lack of jurisdiction.<\/p>\n\n\n\n

Possible Legal Challenge<\/h3>\n\n\n\n

Legal experts quoted in the report noted that the proposal does not involve fresh legislation but instead relies on a particular interpretation of the existing legal provisions.<\/p>\n\n\n\n

However, they also observed that if NAB adopts the interpretation, it could be challenged before the courts. Ultimately, the judiciary would determine whether the inflation-adjustment mechanism can legally be applied only to NAB\u2019s jurisdictional threshold or also to the valuation of alleged financial losses in corruption cases.<\/p>\n\n\n\n
