The Supreme Court dismissed all objections raised by the provincial government and upheld the earlier judgment of the Peshawar High Court.

In its detailed judgment, the apex court emphasized that compensation for acquired land cannot be determined solely on the basis of official government valuation rates. Instead, authorities must also take into account the true market value of the property to ensure that landowners receive just compensation.

The court observed that the guiding principle for compensation should be that “gold should be exchanged for gold, not copper,” underscoring that owners whose land is taken for public purposes should receive compensation that genuinely reflects the value of what they have lost.

According to the judgment, several factors must be considered when assessing compensation, including the future potential and importance of the land, as well as any increase in its value resulting from delays in the acquisition process.

The Supreme Court held that fair compensation is a constitutional right of every citizen whose property is acquired by the state. While governments may obtain land for infrastructure and development projects that serve the public interest, they cannot do so without adequately compensating those affected.

The dispute originated from the acquisition of land in Swabi for a canal development project. Landowners challenged the compensation offered by the government, arguing that the official amount did not reflect the actual market value of their properties.

After examining the evidence presented, the Reference Court increased the compensation payable to the landowners. The Khyber Pakhtunkhwa government challenged that decision, but the Peshawar High Court upheld the enhanced compensation awarded by the Reference Court.

The provincial government subsequently appealed the matter before the Supreme Court, seeking to overturn the increased compensation. However, the apex court rejected the government’s appeal and affirmed the lower courts’ findings.

Legal experts say the judgment reinforces important constitutional protections relating to property rights and could serve as a significant precedent in future land acquisition cases across Pakistan. The ruling highlights that compensation must be based on fairness and economic reality rather than administrative valuation alone.

The decision is also expected to influence how compensation is calculated for future public infrastructure projects, including highways, dams, canals, industrial zones, and other development initiatives requiring the acquisition of private land.

By reaffirming that the state must balance public interest with the constitutional rights of citizens, the Supreme Court has emphasized that development projects should not impose an unfair financial burden on affected landowners. The judgment underscores that equitable compensation is an essential component of lawful land acquisition and a safeguard against arbitrary deprivation of property.

ISLAMABAD: The Supreme Court of Pakistan has ruled that while the state has the constitutional authority to acquire private land for projects serving the public..

[4

post-5106","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-leading
https://paksouch.com/wp-content/uploads/2026/07/437531_4492235_updates-1.jpg",700,400,false
https://paksouch.com/wp-content/uploads/2026/07/437531_4492235_updates-1-150x150.jpg",150,150,true
https://paksouch.com/wp-content/uploads/2026/07/437531_4492235_updates-1-300x171.jpg",300,171,true
https://paksouch.com/wp-content/uploads/2026/07/437531_4492235_updates-1.jpg",700,400,false
https://paksouch.com/wp-content/uploads/2026/07/437531_4492235_updates-1.jpg",700,400,false],"1536x1536":["https://paksouch.com/wp-content/uploads/2026/07/437531_4492235_updates-1.jpg",700,400,false],"2048x2048":["https://paksouch.com/wp-content/uploads/2026/07/437531_4492235_updates-1.jpg",700,400,false
admin
["GET
