The Lahore High Court (LHC) has dismissed the post-arrest bail plea of a man accused of human smuggling and defrauding citizens by offering fake overseas employment opportunities, observing that such offenders do not deserve leniency due to the grave nature of their crimes.<\/p>\n\n\n\n
Justice Tanveer Ahmad Sheikh rejected the bail application, terming the accused\u2019s alleged modus operandi \u201cextremely dangerous and cruel\u201d as it preyed on innocent people seeking better employment prospects abroad.<\/p>\n\n\n\n
According to court records, a case was registered against the accused by the FIA Anti-Human Trafficking Circle (AHTC), Rawalpindi, in 2023 under charges related to human smuggling and violations of immigration laws.<\/p>\n\n\n\n
During the hearing, the defence counsel argued that the accused had been in jail since December 1, 2024, and deserved bail because the challan was submitted with a delay and no prosecution witness had yet recorded a statement before the trial court.<\/p>\n\n\n\n
However, the state prosecutor opposed the request, informing the court that the accused and his accomplices had allegedly received Rs2.5 million from the complainant in exchange for arranging the illegal travel of his son to Europe.<\/p>\n\n\n\n
The prosecutor stated that the victim was first transported from Karachi to Libya and later sent to Italy through illegal channels.<\/p>\n\n\n\n
During the journey, a boat carrying migrants reportedly capsized, and the young man is feared dead. He remains missing to this day.<\/p>\n\n\n\n
In its ruling, the court acknowledged that prolonged detention exceeding one year can be a ground for granting bail, but emphasized that such relief is not an automatic right.<\/p>\n\n\n\n
The court observed that individuals accused of serious and organized crimes, particularly habitual and dangerous offenders, cannot claim bail solely based on delay in trial proceedings.<\/p>\n\n\n\n
Justice Tanveer Ahmad Sheikh noted that the accused’s alleged activities amounted to exploiting vulnerable citizens by luring them with promises of overseas jobs and depriving them of their life savings.<\/p>\n\n\n\n
The judgment described such conduct as a form of \u201cfinancial murder\u201d and held that those involved in such offences are not entitled to judicial concession.<\/p>\n\n\n\n
Considering the seriousness of the allegations and the evidence available on record, the court ruled that the accused was not entitled to post-arrest bail and dismissed the application.<\/p>\n\n\n\n
