Her defense team argued that the incident occurred after years of abuse and financial exploitation that had placed her under severe emotional and psychological stress.

During the hearing, the defense counsel told the court that the deceased husband was unemployed and regularly subjected his wife to physical violence. The lawyer further stated that the husband frequently pressured his wife to obtain money from her parents to support the household and satisfy his financial demands.

The court was informed that Afshan Sehar’s mother had often provided financial assistance to the family despite their own difficulties. However, on the final occasion preceding the incident, the mother reportedly refused to provide additional money. According to the defense, this refusal led to another episode of violence against the woman by her husband.

The lawyer argued that the accused reacted under extreme circumstances and that her dignity and personal safety were under threat. The defense maintained that the killing was not a premeditated act but rather the outcome of prolonged domestic abuse and immediate provocation.

The defense also highlighted that the woman was the mother of four children and had already spent approximately ten years in prison since her arrest in 2016. Her counsel requested the court to take into account the exceptional circumstances surrounding the case and reduce her sentence accordingly.

The prosecution, however, maintained that the woman had intentionally attacked her husband by striking him on the head, resulting in fatal injuries. Prosecutors argued that the death was caused directly by the accused’s actions and that the conviction should therefore remain in place.

During the proceedings, Justice Hashim Kakar made observations regarding the unusual nature of the case. He noted that cases involving domestic violence often feature women as victims rather than perpetrators.

“Usually, it is the husband who kills the wife,” Justice Kakar remarked. “This is the first case I have seen in which a wife has killed her husband.”

Another member of the bench, Justice Ishtiaq Ibrahim, observed that two brothers of the convicted woman had also been nominated in the case during the initial investigation. However, both were later acquitted due to insufficient evidence linking them to the crime.

Justice Kakar further commented on the quality of the prosecution’s evidence, suggesting that if the court were to rely strictly on certain aspects of the evidence presented by the prosecution, all three accused individuals might have been acquitted. His remarks reflected concerns regarding weaknesses in the investigation and prosecution of the case.

After reviewing the facts, legal arguments, and circumstances surrounding the incident, the Supreme Court decided to modify the sentence imposed on Afshan Sehar. Instead of life imprisonment, the court converted the punishment into a fixed sentence of 14 years.

The ruling means that the period already spent in custody by the woman will be counted toward her sentence. Given that she has reportedly been imprisoned since 2016, the decision could significantly affect the remaining duration of her incarceration, depending on applicable legal provisions, remission policies, and prison regulations.

The case has drawn attention because it highlights broader issues related to domestic violence, economic dependence, and the challenges faced by women living in abusive relationships. Human rights advocates have long argued that courts should consider the context of prolonged abuse when evaluating criminal cases involving victims who eventually retaliate against their abusers.

Legal experts say the Supreme Court’s decision does not overturn the conviction but acknowledges mitigating circumstances that influenced the crime. Such factors can play an important role in sentencing decisions, particularly when evidence suggests a history of violence or coercive behavior within a household.

The judgment is expected to generate discussion among legal circles and rights organizations regarding the treatment of domestic abuse cases within Pakistan’s criminal justice system. While the court upheld responsibility for the killing, its decision to reduce the sentence reflects consideration of the difficult circumstances presented by the defense.

The ruling marks the latest example of Pakistan’s higher judiciary examining not only the criminal act itself but also the social and personal factors that may contribute to such incidents. As debate continues over domestic violence and legal protections for vulnerable individuals, the case of Afshan Sehar is likely to remain a significant reference point in discussions about justice, accountability, and compassion within the legal system.

Islamabad: The Supreme Court of Pakistan has reduced the life imprisonment sentence of a woman convicted of killing her husband after years of alleged domestic..

[3

post-3029","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-pakistan
https://paksouch.com/wp-content/uploads/2026/06/435526_6598899_updates-1.jpg",700,400,false
https://paksouch.com/wp-content/uploads/2026/06/435526_6598899_updates-1-150x150.jpg",150,150,true
https://paksouch.com/wp-content/uploads/2026/06/435526_6598899_updates-1-300x171.jpg",300,171,true
https://paksouch.com/wp-content/uploads/2026/06/435526_6598899_updates-1.jpg",700,400,false
https://paksouch.com/wp-content/uploads/2026/06/435526_6598899_updates-1.jpg",700,400,false],"1536x1536":["https://paksouch.com/wp-content/uploads/2026/06/435526_6598899_updates-1.jpg",700,400,false],"2048x2048":["https://paksouch.com/wp-content/uploads/2026/06/435526_6598899_updates-1.jpg",700,400,false
admin
["GET
