Islamabad: The Islamabad High Court has issued a restraining order preventing the eviction of apartment owners from the One Constitution Avenue residential project until further orders.<\/p>\n\n\n\n
The order was issued by a division bench comprising Justice Muhammad Azam Khan and Justice Inam Amin Minhas during the hearing of intra-court appeals filed by several apartment owners, including former Air Chief Mujahid Anwar Khan, former ICC President Ehsan Mani, former Senate Chairman Wasim Sajjad, and others.<\/p>\n\n\n\n
During the proceedings, the court heard arguments from both the Capital Development Authority (CDA) and lawyers representing the residents regarding the controversial status of the high-profile residential project located in Islamabad.<\/p>\n\n\n\n
CDA\u2019s counsel Kashif Ali Malik informed the court that the CDA chairman had recently returned from abroad and that a response had already been submitted despite his absence.<\/p>\n\n\n\n
Justice Inam Amin Minhas remarked that while the complete case would be heard later, the court was currently considering the residents\u2019 request for a stay order against eviction.<\/p>\n\n\n\n
The CDA\u2019s lawyer argued that the appeals themselves were not maintainable. However, the bench questioned whether the rights of apartment owners had been properly considered during earlier proceedings, including matters that had reached the Supreme Court.<\/p>\n\n\n\n
Justice Inam Amin Minhas observed that according to the order being challenged, the residents still appeared to possess certain legal rights.<\/p>\n\n\n\n
The court also questioned CDA officials regarding the handling of the building and its occupancy status over the years.<\/p>\n\n\n\n
Justice Inam Amin Minhas asked when the CDA had appointed an administrator for the building. Advocate Ali Raza informed the court that an administrator had been appointed on March 12, 2023.<\/p>\n\n\n\n
Residents\u2019 counsel Sardar Taimur Aslam argued that the CDA itself had repeatedly sought time for internal board decisions and that a residents\u2019 committee had already been managing the building affairs.<\/p>\n\n\n\n
He further stated that the federal government had formed a high-level committee to review the One Constitution Avenue issue and that its recommendations were still pending approval from the federal cabinet before any matter could proceed before the CDA board.<\/p>\n\n\n\n
The lawyer questioned whether authorities intended to take possession of the apartments during the Eid holidays despite the pending legal and administrative process.<\/p>\n\n\n\n
Another counsel representing residents argued that the CDA had previously recognized the rights of apartment owners and had even collected lease-related payments ranging between 15 to 18 percent from residents.<\/p>\n\n\n\n
During the hearing, the judges raised serious questions regarding the CDA\u2019s oversight and regulatory role in allowing people to occupy the building despite incomplete legal formalities.<\/p>\n\n\n\n
Justice Muhammad Azam Khan directly asked whether the building had ever received a completion certificate. In response, CDA counsel Kashif Malik admitted that the building had not yet been issued a completion certificate.<\/p>\n\n\n\n
The judge then remarked: \u201cWas the CDA sleeping when residents started living there without the issuance of a completion certificate?\u201d<\/p>\n\n\n\n
The court also questioned why the CDA had recognized and allowed residents to occupy the apartments if the building\u2019s legal status remained unresolved.<\/p>\n\n\n\n
Justice Inam Amin Minhas further observed that if the BNP company did not file an appeal against the single bench decision, it did not necessarily mean that apartment owners lost all legal rights connected to the property.<\/p>\n\n\n\n
Despite CDA\u2019s arguments that the appeals were legally inadmissible, the bench decided to grant interim relief to the residents.<\/p>\n\n\n\n
After hearing arguments from all parties, the Islamabad High Court ordered that apartment owners of One Constitution Avenue should not be evicted until further orders are issued in the case.<\/p>\n\n\n\n
