{"id":15893,"date":"2026-09-16T11:50:48","date_gmt":"2026-09-16T11:50:48","guid":{"rendered":"https:\/\/paksouch.com\/?p=15893"},"modified":"2026-09-16T11:51:08","modified_gmt":"2026-09-16T11:51:08","slug":"sc-adjourns-imran-khans-hospital-transfer-case-for-three-weeks-amid-questions-over-constitutional-courts-jurisdiction","status":"publish","type":"post","link":"https:\/\/paksouch.com\/?p=15893","title":{"rendered":"SC adjourns Imran Khan\u2019s hospital-transfer case for three weeks amid questions over Constitutional Court\u2019s jurisdiction"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">ISLAMABAD: The Supreme Court on Wednesday adjourned for three weeks the hearing of PTI founder and former prime minister Imran Khan\u2019s hospital-transfer case after Attorney General Mansoor Usman Awan assisted the bench on a jurisdictional dispute triggered by the Federal Constitutional Court\u2019s decision to summon records of the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The hearing was marked by questions from Justice Shahid Waheed about the scope of the FCC\u2019s powers, including whether it could summon cases pending before the Supreme Court and whether its orders were binding on the apex court. The bench headed by Justice Waheed comprising Justice Naeem Akhtar Afghan and Justice Ishtiaq Ibrahim, resumed the hearing of petitions related to former prime minister and Pakistan Tehreek-e-Insaf (PTI) Imran Khan\u2019s medical treatment and meetings with his family members.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proceedings resumed after a break with Awan reading out the FCC\u2019s order, which directed that records of cases pending before the Supreme Court be summoned and the cases subsequently fixed for hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cUnder the Constitution, the Constitutional Court can summon not only the record of cases but also the cases themselves,\u201d Awan told the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Waheed questioned the wording of the order, particularly its direction that the cases be fixed before the FCC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe order says that after summoning the records, the cases should be fixed for hearing,\u201d he said. \u201cThe phrase \u2018fix the cases\u2019 is troubling us.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Awan said the court first needed to determine the extent of the FCC\u2019s power to summon records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt has to be determined how and from where the Constitutional Court can summon records,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe primary question here is what the jurisdiction of this court is,\u201d Awan added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Waheed said the bench\u2019s questions were aimed at understanding the constitutional framework rather than creating a confrontation between the two superior courts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe want to understand the intent of the Constitution,\u201d he said. \u201cWe believe in mutual respect among the judiciary.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPlease do not take these questions negatively; they are only being asked for the purpose of understanding,\u201d the judge added.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Quran, Sunnah and constitutional jurisdiction<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The discussion then turned to the extent of the FCC\u2019s jurisdiction in matters concerning the Quran and Sunnah.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Constitutional Court cannot interfere in matters concerning the Quran and Sunnah,\u201d Justice Waheed said. \u201cThe Constitutional Court can only interpret the Constitution.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cApart from constitutional interpretation, all matters fall within the Supreme Court\u2019s jurisdiction,\u201d he added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Awan said the Supreme Court\u2019s Shariat Bench retained the authority to interpret the Quran and Sunnah.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Shariat Bench of the Supreme Court can interpret the Quran and Sunnah,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Waheed then questioned whether the FCC would be bound by Supreme Court judgments based on the Quran and Sunnah.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere is nothing above the Constitution, the law and the Holy Quran in the country,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWill the Constitutional Court not be bound by a Supreme Court judgment made in light of the Quran and Sunnah?\u201d the judge asked.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Awan responded that Article 189 of the Constitution was clear regarding the application of judicial decisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cArticle 189 is clear regarding the application of judgments,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The attorney general also said he would limit his assistance to the question of jurisdiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI will not comment on questions concerning the Constitutional Court,\u201d Awan said. \u201cI will assist the court on the issue of jurisdiction.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis is the first case of its kind,\u201d he added.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Fundamental rights also under scrutiny<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Waheed also questioned the FCC\u2019s order concerning cases involving fundamental rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Constitutional Court\u2019s order says it will determine which court can hear cases involving fundamental rights,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe issue of fundamental rights arises in every case,\u201d the judge added. \u201cThe fundamental right to a fair trial arises in every criminal case.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Awan maintained that the jurisdictions of the two courts were defined by the Constitution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe jurisdictions of the Constitutional Court and the Supreme Court are clearly defined in the Constitution,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Waheed then questioned whether the Supreme Court was bound by the FCC\u2019s order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cCan the order issued by the Constitutional Court be applied to us?\u201d he asked.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAre we bound by the order of the Constitutional Court?\u201d he further questioned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge also asked whether the Supreme Court should dismiss the petitions or refrain from hearing them while the jurisdictional question remained unresolved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cShould the court dismiss the petitions today or decline to hear them?\u201d Justice Waheed asked.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Jail officials absent despite summons<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The bench also expressed displeasure over the absence of government officials, including Adiala Jail authorities, who had been summoned to appear in person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAdiala Jail authorities had been summoned in person today,\u201d Justice Waheed said. \u201cNone of the government officials appeared.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Supreme Court\u2019s order has been violated,\u201d he said, adding that there was \u201ca severe lack of trust and communication.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Awan acknowledged that the officials should have appeared but asked the court to give them another opportunity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe government officials should have appeared today,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Waheed asked, \u201cShould we issue warrants for the jail superintendent?\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt would be appropriate to give them one opportunity,\u201d Awan responded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He suggested that the officials may have believed the hearing would not take place.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe officials may have understood that the case would not be heard today,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Waheed also referred to the government\u2019s position in its review petition that treatment could not be provided at a private hospital.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe government has stated in its review petition that treatment cannot be provided at a private hospital,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Supreme Court\u2019s order was not implemented,\u201d the judge added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Awan told the bench that the record sought by the court had been provided.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe record has been provided in compliance with the court\u2019s order,\u201d he said.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Hearing began without govt representative<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier, no government representative had initially appeared before the court, prompting the bench to summon Awan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Barrister Ali Zafar appeared on behalf of Mishal Yousafzai, while Additional Attorney General Rana Asad appeared later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rana informed the bench that the FCC had taken up the matter from the Supreme Court a day earlier and had issued an order to that effect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Federal Constitutional Court took the case from the Supreme Court yesterday,\u201d he told the bench.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Waheed directed Rana to read out the FCC\u2019s order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the order was read in court, the judge asked whether the attorney general was in his office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cYes, the attorney general is present,\u201d Rana replied.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThen call the attorney general,\u201d Justice Waheed directed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court subsequently summoned Awan, after which the judges left the courtroom and the hearing was adjourned for a second time.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">FCC intervention raises jurisdiction issue<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The FCC\u2019s decision to seek the record of Khan\u2019s hospital-transfer case from the Supreme Court raised a jurisdictional question ahead of the apex court\u2019s hearing of a contempt petition over the alleged non-implementation of its Aug 18 order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FCC\u2019s three-member bench, headed by Chief Justice Aminuddin Khan, issued the order while hearing petitions filed by three Adiala prisoners seeking permission to receive treatment at private hospitals. It directed its registrar to obtain Khan\u2019s case record, along with records of similar matters pending before the Supreme Court and high courts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The move followed arguments by Awan that the FCC had the power under Article 175E(5) of the Constitution to call for the record of a case pending before any court where it involved a substantial question of law relating to constitutional interpretation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Ali Baqar Najafi asked whether the government had raised the jurisdictional objection before the Supreme Court. Awan said an additional attorney general had done so, but the Supreme Court issued its Aug 18 order without giving the government notice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Najafi also questioned whether the Supreme Court should first have determined the maintainability of the petition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Aamer Farooq noted that the matter before the Supreme Court was criminal in nature and that its Aug 18 order was interim.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Khan\u2019s hospital-transfer order<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">On Aug 18, the Supreme Court ordered that Khan be shifted from Adiala jail to Shifa International Hospital for medical examination and treatment in the presence of his sister, Dr Uzma Khan, and physician Dr Faisal Sultan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Khan was instead taken to PIMS for examination before being returned to Adiala.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dr Uzma subsequently filed a contempt petition, alleging that the government had failed to implement the Supreme Court\u2019s directive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FCC proceedings stemmed from petitions filed by three Adiala prisoners who also sought permission to receive treatment at private hospitals. The Islamabad High Court had rejected their pleas, holding that prisoners did not have a legal or fundamental right to treatment at a private hospital of their choice, while noting that transfer could be permitted if recommended by a medical board and the required treatment was unavailable at a government hospital.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FCC\u2019s intervention comes against the backdrop of the 27th Constitutional Amendment, which established the court and altered the distribution of constitutional jurisdiction. In previous judgments, the FCC has held that its decisions are binding on all courts, including the Supreme Court, while the binding effect of Supreme Court judgments under Article 189 does not extend to the FCC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the close of Wednesday\u2019s proceedings, the petitioners\u2019 counsel told the court, \u201cWe have filed two contempt of court petitions.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court then began dictating its order and accepted Awan\u2019s request to defer the hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn these circumstances, we accept the Attorney General\u2019s request that the hearing be adjourned,\u201d the court said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Waheed told Awan: \u201cWe have complete confidence in you, Attorney General.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The hearing was adjourned for three weeks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">PAK SOUCH MEDIA GROUP<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Daily Pak Souch Newspaper Sukkur \u2013 Daily Pak Special Newspaper Karachi \u2013 Daily Pak Today Newspaper Karachi &#8211;
