The Islamabad High Court (IHC) has declared that no political party or public office-holder has the authority to block the roads in the federal capital.<\/p>\n\n\n\n
A three-judge IHC bench led by Chief Justice Sarfraz Dogar and comprising Justice Azam Khan and Justice Asif pronounced the verdict regarding PTI\u2019s September 27 protest and long march reserved hours earlier on Monday.<\/p>\n\n\n\n
The court directed the chief ministers of the provinces to ensure that government machinery was not used for political party protests.<\/p>\n\n\n\n
It also ordered that no government official should carry out an order that forces them to participate in a protest or rally. Any official who faces such pressure must immediately inform the relevant chief secretary, chief commissioner or inspector general of police, the court directed.<\/p>\n\n\n\n
The court further ordered government officials not to allow their subordinates to participate in any march or protest coming to Islamabad. The ruling followed the court\u2019s earlier proceedings on the PTI\u2019s planned September 27 protest and long march.<\/p>\n\n\n\n
During those proceedings, arguments were presented over the nature of the proposed protest and the possible use of government resources.The Islamabad High Court subsequently disposed of the petition.<\/p>\n\n\n\n
Earlier, the IHC reserved its decision in a case challenging the Pakistan Tehreek-e-Insaf\u2019s (PTI) proposed September 27 protest and long march.<\/p>\n\n\n\n
Islamabad Advocate General Naveed Hayat Malik presented arguments before the court. Acting Prosecutor General Manzoor Jajja, Khyber Pakhtunkhwa Inspector General of Police Zulfiqar Hamid and Chief Secretary Shahab Ali Shah also appeared before the bench.<\/p>\n\n\n\n
The chief secretary and inspector general submitted affidavits to the court during the proceedings.<\/p>\n\n\n\n
The Islamabad Advocate General argued that the protest had two objectives: the release of a convicted prisoner [PTI founder Imran Khan] and the removal of the government.<\/p>\n\n\n\n
Islamabad Advocate General Naveed Hayat Malik said there was no evidence to show that the planned rally would remain peaceful.<\/p>\n\n\n\n
He also argued that if they [an opposition party] were unhappy with the prime minister, it should go to parliament and seek a vote of no confidence.<\/p>\n\n\n\n
During the hearing, the advocate general said PTI leaders were claiming that the long march would be peaceful and that they were coming to strengthen the judiciary.<\/p>\n\n\n\n
He then told the court that he wanted to read statements made by PTI leaders, including one in which a leader had said the choice was between freedom and martyrdom.<\/p>\n\n\n\n
The advocate general also sought permission to play videos of the PTI\u2019s November 2024 protest before the court.<\/p>\n\n\n\n
Chief Justice Sarfraz Dogar initially said that playing videos was not the tradition of the Islamabad High Court. The advocate general replied that videos had also been played in the Supreme Court.<\/p>\n\n\n\n
The chief justice responded that such videos might be played in the Supreme Court, but they would not be shown in this court because the bench did not want to establish a tradition of continuously playing videos during proceedings.<\/p>\n\n\n\n
The chief justice said the bench wanted to examine the advocate general\u2019s miscellaneous application. The court then took a short break in the hearing.<\/p>\n\n\n\n
After the break, the chief justice allowed the videos of the PTI\u2019s November 2024 protest to be played in court.<\/p>\n\n\n\n
